The long-running land dispute involving Komarock Housing Cooperative Society Ltd has suffered another setback after the Machakos Court postponed the case yet again, pushing the hearing to June 9, 2025. The delay has left members frustrated after over a decade of legal battles.
Hopeful for a final verdict, members led by their chairman Benard Maembe arrived at the Machakos Court today, only to be informed that their case would not proceed as expected. This marks yet another postponement since the dispute began in July 2013.
“We have been in court for years, waiting for justice. We just want a solution so we can move on. The delays are frustrating,” said Maembe, voicing the concerns of hundreds of affected members.
The case is now under Lady Justice Muthoka, raising hopes that fresh leadership may finally steer the matter toward resolution. Wakili Benard Mung’ata, an advocate of the High Court, expressed disappointment over the delay but remained optimistic about progress.
“The matter is now being handled by new judges who have agreed to proceed. While the next hearing is now set for June 9th, I believe we are closer than ever to a conclusion,” said Mung’ata.
Further compounding frustrations, Commissioner Johnstone Muthama, a key figure in the case, was absent due to illness, leaving some members worried about even more delays in securing a final ruling.
“We have been patient for too long. We just want our land back, and this case needs to be finalized,” one member lamented.
With the next session now scheduled for June, Benard Maembe, Wakili Mung’ata, and the entire Komarock Housing Cooperative Society Ltd remain hopeful that justice is within reach. However, after more than a decade of delays, the question remains—will June 9, 2025, finally bring closure?
